Welcome to BatPathIQ. By accessing or using our website and services, you agree to these Terms of Service. If you don’t agree, please don’t use our services.

1. Services Overview

BatPathIQ provides online video swing analysis coaching for baseball and softball players, training products, and digital educational content including:

  • Video submission and analysis
  • Custom drill prescriptions
  • Educational content library
  • Progress tracking and skill level advancement
  • Monthly coaching calls (Elite tier only)
  • Training kits and equipment
  • Digital products (PDFs, curriculum materials, drill guides)

2. Membership Tiers and Pricing

Year-Round Coaching Memberships

All membership tiers are available year-round. We offer coaching services whenever you need them – during off-season mechanical work, in-season adjustments, or mental game preparation.

Mental Game Tier: $47/month

  • In-season mental approach training
  • Visualization and journaling content
  • Tournament preparation strategies
  • Confidence building techniques
  • Approach and mindset development
  • Available anytime, unlimited spots

Development Tier: $147-197/month

  • 2 video analyses per month (bi-weekly)
  • Custom drill prescriptions based on your swing
  • Full drill library access
  • Progress tracking through skill levels
  • Educational content
  • Available year-round
  • LIMITED TO 20 SPOTS MAXIMUM (scarcity model)

Elite Tier: $297-397/month

  • Everything in Development Tier
  • Monthly 30-minute one-on-one coaching call
  • Priority 24-hour analysis turnaround
  • Elite-only advanced content library
  • Direct messaging access for questions
  • Personalized attention
  • Available year-round
  • LIMITED TO 5 SPOTS MAXIMUM (scarcity model)

Our Philosophy

We help players when they need it. While we generally recommend focusing on mechanical changes during the off-season and mental game during active play, life doesn’t always work that way. Some players need help mid-season, can only train during summer, or face unique circumstances. We adjust our coaching approach based on timing and your specific situation, but all services remain available year-round.

Pricing Notes

  • Prices are in USD and billed monthly for memberships
  • Founding member rates may be locked in at discounted prices
  • We reserve the right to change prices with 30 days’ notice
  • Price changes don’t affect existing members’ locked rates

3. Product Purchases

Physical Products

We sell training equipment, kits, and tools including but not limited to:

  • Training aids and equipment
  • Complete training kits
  • Baseball/softball gear and accessories

Physical Product Terms:

  • One-time purchase, not subscription
  • Prices shown in USD
  • Shipping costs calculated at checkout
  • Delivery times vary by location (typically 5-14 business days within North America)
  • You are responsible for customs/duties for international orders
  • Risk of loss passes to you upon delivery
  • Defective products covered under warranty (see Refund Policy)

Digital Products

We sell digital educational content including:

  • PDF drill guides and curriculum
  • Video training series
  • Educational materials
  • Mental game workbooks
  • Skill development programs

Digital Product Terms:

  • One-time purchase, instant delivery via email/download
  • Non-refundable once accessed (see Refund Policy for exceptions)
  • For personal use only – may not be shared, resold, or distributed
  • We retain all copyright and intellectual property rights
  • You receive a personal, non-transferable license to use

Product Availability

  • Products subject to availability
  • We reserve the right to discontinue products
  • Out-of-stock items will be noted on product pages
  • We’ll notify you if ordered items become unavailable

4. Account Registration

To use our services, you must:

  • Be at least 18 years old (or have parental consent)
  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of unauthorized account access
  • Be responsible for all activity under your account

Parents/guardians must create accounts for players under 18.

5. Subscription Terms

Billing

  • Subscriptions auto-renew monthly on your registration date
  • Payment is charged to your chosen method automatically
  • Failed payments may result in service suspension
  • You’re responsible for keeping payment information current

Cancellation

  • You can cancel anytime through your account settings
  • Cancellation takes effect at the end of your current billing period
  • No refunds for partial months (see Refund Policy)
  • Access continues until the end of your paid period

Service Limitations

  • Development and Elite tiers have limited spots (scarcity model)
  • Spot availability is first-come, first-served
  • Waitlist may be implemented when tiers are full
  • We reserve the right to refuse service to anyone

6. Video Submission Guidelines

Your Responsibilities

  • Submit clear, properly lit swing videos
  • Follow filming guidelines provided
  • Videos must be of yourself or someone you have permission to record
  • Maximum file size: 500MB per video
  • Supported formats: MP4, MOV, AVI

Our Analysis Process

  • Standard turnaround: 48-72 hours
  • Elite tier turnaround: 24 hours
  • Analysis provided via video response and written drill prescription
  • Side-by-side comparisons for progress tracking

Video Content Rules

You may NOT submit videos containing:

  • Inappropriate, offensive, or illegal content
  • Copyrighted material you don’t have rights to
  • Content that violates others’ privacy
  • Misleading or fraudulent information

7. Intellectual Property

Our Content

All BatPathIQ content (videos, drills, educational materials, analysis methods, curriculum, PDFs, digital products) is our intellectual property and protected by copyright. You may NOT:

  • Reproduce, distribute, or sell our content
  • Share your account access with others
  • Download and redistribute drill videos or digital products
  • Use our methods commercially without written permission
  • Copy, modify, or create derivative works from our materials
  • Remove copyright notices or watermarks

Violation Consequences

Unauthorized use of our intellectual property may result in:

  • Immediate account termination without refund
  • Legal action to protect our rights
  • Claims for damages and attorney fees

Your Content

  • You retain ownership of videos you submit
  • You grant us license to use submitted videos for providing our services
  • We will NOT use your videos for marketing without explicit written permission
  • You can request deletion of your content at any time

8. Disclaimers and Limitations

No Guarantees

  • We provide coaching and analysis, not guaranteed results
  • Individual results vary based on effort, practice, natural ability, and many other factors
  • We don’t guarantee skill improvement, performance outcomes, scholarships, or college recruitment
  • Baseball/softball involves inherent risks of injury

Not Professional Medical Advice

  • Our services are for educational and coaching purposes only
  • We are not medical professionals, physical therapists, or licensed healthcare providers
  • Consult a doctor before starting any new training program
  • Stop any activity that causes pain or discomfort immediately

Product Disclaimers

  • Training products are tools, not guarantees of improvement
  • Follow all product safety instructions
  • Inspect products before use
  • Products are for baseball/softball training purposes only
  • Use appropriate safety equipment when training

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid in the past 12 months
  • We are not responsible for injuries sustained while following our programs or using our products
  • You use our services and products at your own risk
  • We are not liable for shipping delays, lost packages, or carrier issues
  • We are not liable for results or lack of results from coaching or products

9. User Conduct

You agree to NOT:

  • Harass, abuse, or threaten our staff or other users
  • Spam, phish, or send malicious content
  • Attempt to hack, disrupt, or overload our systems
  • Create multiple accounts to circumvent limitations
  • Violate any applicable laws or regulations
  • Misrepresent your identity or affiliation
  • Share, resell, or distribute our copyrighted content
  • Use our services or products for any illegal purpose

Violations may result in immediate account termination without refund and potential legal action.

10. Termination

By You

You can cancel your subscription at any time as described in Section 5.

By Us

We may suspend or terminate your account if you:

  • Violate these Terms of Service
  • Engage in fraudulent activity
  • Abuse our staff or services
  • Fail to pay your subscription fees
  • Infringe on our intellectual property
  • Engage in conduct that harms BatPathIQ or other users

Terminated accounts are not eligible for refunds.

11. Shipping and Delivery (Physical Products)

Shipping Policy

  • We ship within 2-5 business days of order placement
  • Shipping carriers: Canada Post, UPS, FedEx (we select carrier)
  • Tracking provided via email when order ships
  • Delivery times: 5-14 business days within North America
  • International shipping available (longer delivery times, customs may apply)

Shipping Costs

  • Calculated at checkout based on destination and weight
  • Free shipping may be offered on orders over certain amounts
  • You pay all shipping costs and any customs/duties

Delivery Issues

  • Verify shipping address before completing purchase
  • We are not responsible for incorrect addresses provided by you
  • Contact us within 48 hours of delivery for damaged shipments
  • Lost packages: Contact us after carrier’s expected delivery timeframe

Undeliverable Packages

  • Returned packages due to incorrect address may incur reshipping fees
  • Refused packages subject to restocking fee
  • Unclaimed packages may be refunded minus shipping costs

12. Modifications to Services

We reserve the right to:

  • Modify, suspend, or discontinue any part of our services
  • Change membership tiers, features, or pricing structure
  • Update drill content and educational materials
  • Implement new policies or guidelines
  • Discontinue products or digital content

We’ll provide reasonable notice of material changes when possible.

13. Dispute Resolution

Governing Law

These Terms are governed by the laws of Saskatchewan, Canada, without regard to conflict of law principles.

Informal Resolution

Before filing any legal claim, you agree to contact us to attempt informal resolution: support@batpathiq.com

Binding Arbitration

For disputes that cannot be resolved informally, both parties agree to binding arbitration in Regina, Saskatchewan, Canada rather than court litigation, except for small claims court matters.

14. General Provisions

Entire Agreement

These Terms, along with our Privacy Policy, Refund Policy, and Disclaimer, constitute the entire agreement between you and BatPathIQ.

Severability

If any provision is found unenforceable, the remaining provisions remain in full effect.

No Waiver

Our failure to enforce any right or provision doesn’t constitute a waiver of that right.

Assignment

You may not transfer your account or these Terms. We may assign our rights and obligations to another entity.

Force Majeure

We’re not liable for failures caused by events beyond our reasonable control (natural disasters, internet outages, pandemics, shipping carrier delays, supplier issues, etc.).
